  • Acting Governor of California does not file an appeal in the Prop 8 case as deadline passes.

  • American hiker released from Iranian jail.


  • Castro set to fire half of all Cuban government employees and make the private sector less restrictive.

  • US Federal Government takes incremental step towards extending some benefits to gay federal employees. This is a good thing and I'm very glad to see it. However, this represents only a fraction of the rights heterosexual families enjoy.

  • Harry Reid schedules Senate vote on Defense Authorization Bill which contains language allowing consideration of possible repeal of DADT "some day." (Via Joe My God)

  • The Ninth Circuit Court of Appeals has extended Judge Walker's stay to give a three-judge panel time to consider whether Prop8 proponents have Article III standing to appeal the case. The hearing is scheduled for December 6th.  CNN refers to California's marriage amendment as "controversial." Taking away people's civil rights is now "controversial." Whew!

  • Defenders of "Traditional Marriage" must submit their brief at 9AM PST to thwart the happiness of expectant couples across California. Will the 9th Circuit's three judge panel grant their motion to stay? or will Judge Walker's ruling striking down Prop 8 go into effect?

The End of Prop 8: What the Constitution is all About

  • Much buzz yesterday (and today) about whether or not supporters of Prop 8 have standing to ask for a stay of Judge Walker's ruling. In a nutshell, opponents of marriage equality failed to prove any harm to themselves or anyone else at trial; and both the Governator and Attorney General of California want to resume issuing marriage licenses to everyone. The Gov. and AG are the ones who have standing, not Cooper, Thompson et al. Walker's decision on the stay could come at any moment.

  • National Public Radio frets over Prop 8 ruling. Describes Walker's judgment as bad news for Democrats. Excuse me? "Baltimore is not ready for integrated dancing!"


  • Towleroad has a great media round-up of telly coverage for the Prop 8 ruling. I highly recommend the Rachel Maddow footage eviscerating the pathetic bigot "experts." Rachel also chats with Dahlia Lithwick. Give it a look-see.

Down With Homophobic Punctuation Marks!

Judge Walker's ruling will go down in history along side Brown v. Board of Education and Loving v. Virginia. A couple of my favorite nuggets follow.

The simplest, truest statement I read:

"...(T)he Equal Protection Clause renders Proposition 8 unconstitutional under any standard of review."

Walker makes clear that Prop 8 was based on animus:

"Many of the purported interests identified by proponents are nothing more than a fear or unarticulated dislike of same-sex couples."

Walker also suggests that those little quote marks the bigots like to use (homosexual "marriage") are unconstitutional too:

"Plaintiffs do not seek recognition of a new right. To characterize plaintiffs’ objective as “the right to same-sex marriage” would suggest that plaintiffs seek something different from what opposite-sex couples across the state enjoy--namely, marriage. Rather, plaintiffs ask California to recognize their relationships for what they are: marriages."

Well, that about wraps it up for bigotry.

Prop 8 Closing Arguments: Nolite Te Bastardes Carborundorum

My reading of Mr. Cooper's final arguments in the Prop 8 trial lead to a couple of interesting conclusions. If Mr. Cooper's reasoning is correct, then:
  1. The brute force of the State should be used to determine who has kids and who doesn't.
  2. All forms of birth control and any non-procreative sex should be regulated by the State, which has the inherent right and duty to regulate all forms of intimacy.
  3. Gay people should not be allowed to adopt or raise our own children. In fact, gays shouldn't be allowed near any children, ever. (There's only one way to achieve that...)
Welcome to The Republic of Gilead and blessed be my fellow Gender Traitors. And I'm not just talking about teh gays. This should freak out anyone who wants to choose what they do with their own bodies.

Today in laughable stupidity:


In closing arguments in the Prop 8 trial yesterday Mr. Cooper Esq. demanded that gay marriage be banned because it breaks the holy bond between "sex and diapers."


Tell that to David Vitter.


Do these people know how ridiculous they are?

In other news:

  • As we approach the 41st anniversary of the events that led to the start of the modern gay rights movement, the NYT reviews Kate Davis and David Heilbroner's new film "Stonewall Uprising." David Carter's book on Stonewall, upon which the film is based, was spectacular by the way. It made my pulse race and my blood boil and I consider it a must-read. Go to your local, independent bookstore and buy a copy today. Go now!


  • Following the President's Tuesday address to the nation, the White House tries to assert itself on climate bill. Is it just me, or is it that every time Obama speaks up, someone has to claim that the the President isn't backing away from his commitments?

Prop 8 Closing Arguments: An Idea On Trial

Well, today was the big day and I've started reading the transcripts for the complete closing arguments in the Prop 8 case. The prop 8 Trial tracker coverage starts here. The Firedoglake coverage can be found here.

There are a lot of intersecting issues that I plan to explore over the next few days as I sift through the record.

The first thing that springs out at me from Olsen's closing argument is that the proponents of Prop 8 do not have a rational reason for the passage of their gay marriage ban. All they have is fear that marriage equality "might" harm society "some how."

Pretty flimsy. Especially since that's not how they sold Prop 8 to the people of California.

Their messaging leading up to California's vote was that Prop 8 was necessary to protect children from the idea that gay people are OK. But during the trial, they kept trying to imply that the passage of Prop 8 had nothing to do with animus.

How can you claim that the idea of me is enough to damage vulnerable children, and then turn around and claim you have nothing against me?

You can't.

Win or lose, this case is a game changer for the entire GLBTQ movement.

More tomorrow. I'm going to go make dinner now.

Closing arguments in the Prop 8 Trial today. The Prop 8 Trial Tracker, Firedoglake and JoeMyGod, among others, will be liveblogging as everything unfolds. I will post updates later today as well. Riveting drama, n'est pas?

Balls. As part of their final filings in the case, anti-equality lawyers not only want Judge Walker to uphold Prop 8 but they want him to strike down the 18,000 marriages the CA Supreme Court already upheld. (Via JMG)

It's like Camelot all over again. First Lady and daughters visit LA with much attendant hoopla.

Winking? Two Marines face possible hate-crimes charges for nearly beating a gay man to death "because he winked at them." I guess I'll tape my eyes open the next time the Fleet is in town.

"Discrimination is expensive" say Scouts. Boy Scouts of America back in court to defend their right to exclude queers (at taxpayer expense) in Philadelphia. At stake: a sweetheart, $1-a-year lease on a property that should cost them $200,000 annually.

The Flaming Chef says:
I've said it before and I'll say it again: Homophobia is a business and as much as we are fighting to change the law, we are fighting to make that business model unprofitable.
Having my marriage recognized will be a victory, but the day Maggie Gallagher has to get a real job will be truly sweet...

President Obama describes the transformative nature of the BP spill as "(shaping) how we think about the environment and energy for many years to come." Obama will address the nation on the evening of Tuesday the 15th as concerns continue about BP's dedication to paying for cleanup and damages.

Israel has decided: There will be an official inquiry into the Gaza Flotilla raid.

David Boies describes case against marriage equality as complete crap. (I'm paraphrasing, but that's the gist of it.) Closing arguments will proceed this Wednesday.

Orrin Hatch is a putz.

Jimmy Dean shuffles off this mortal coil at 81. "Taste that country goodness."

Morning News 5/19/10



Choose And Perish! Nate Silver over at 538 dot com has a swell wrap-up of yesterday's elections and what they mean.

Paul Defeats Grayson in Kentucky, Sestak defeats Specter in Pennsylvania, Lincoln and Halter head to run-off in Arkansas and conventional wisdom leaves a lot to be desired.

In local news, the Oregon governor's race will be Kitzhaber v. Dudley in evening wear, swimsuit and talent. I hear Dudley can open a can of Bud with his bellybutton, so the Democrats better watch out.

Not My Mess. Turns out tar balls washing ashore in Florida Keys are not from the BP spill. Are we supposed to be relieved about that?

Also in Florida Filth: Continuing damage from the George (totally-not-gay) Rekers scandal. AG Bill McCollum faces scrutiny for hiring the discredited bigot-asshole (at taxpayer expense). In fact, Rekers "expert" testimony played a part in both the Florida gay adoption ban and the Prop 8 case.

Analysis: Why the Prop 8 Trial Matters


The Prop 8 trial drawing to a close in federal court in California is the most important legal case put forward on behalf of gays and lesbians, ever. It may sound incredible, but in a sense, we are fighting over whether or not gay people exist in the eyes of the federal government, and whether or not there is such a thing as discrimination against us.

Not everyone wants to read all 2,951 pages of the court transcripts, but since I did, I want to offer a very short overview of this case as I see it.

The Olsen/Boies team has offered clear and comprehensive evidence that California's constitutional marriage ban:

1. Harms gay citizens and our families.
2. Violates federal constitutional gauranties of due process and equal protection.
3. Was passed in a manner consistent with historical patterns of anti-gay prejudice.
4. Is indicative of the fact that gays and lesbians do not possess a meaningful amount of political power in the American Legal system. In fact, LGBT's are more statutorily disadvantaged than African Americans and women were when they were granted suspect and quasi-suspect classification.

On the other side of the case, the proponents of Prop 8 have left enormous gaps in their "argument."

1. They have no evidence to support their claim that marriage equality harms society.
2. They agree with our experts that the marriage ban harms gay couples and our families.
3. They agree with our experts that marriage equality would benefit gay families and help reduce anti-gay prejudice.
4. They did not provide a meaningful rebuttal to our side's argument that gays and lesbians do not possess a meaningful amount of political power.
5. They agree that prop 8 stripped a disfavored minority of a fundamental, constitutional right.

The shortest and best overview of our side's case is the Plaintiff's Proposed Findings of Fact and Conclusions of Law, which you can find in .pdf form here. It is a tour de force of legal scholarship with a clear, logical flow and will go down in history as a masterpiece.

The Proponents summary however, is an irritating, 223 point bullet list replete with innuendo, homophobic smears and woolly thinking. It lacks logical flow and does not construct or follow a coherent line of reasoning.

We are still waiting for the judge to schedule closing arguments and I will keep you posted as soon as I hear anything.
